CHAMPIONING FAIRNESS IN RECRUITMENT CONTRACT

The mission statement of Strategic Risk & Compliance Consultancy (SRC) is to champion best practice in risk & compliance for the professional recruitment sector.


I’m one of those nerds who enjoys reading contracts.


However I get frustrated when I read contracts that don’t reflect the exceptional recruitment service that agencies provide & enforce inappropriate onerous indemnities.


This week I was fortunate enough to be given a ‘soap box’ by Contractor UK Limited to speak out about, what I consider to be, unethical tax indemnities.


This article is worth reading as it is essential we continue to push back against clients who seek to side-step their legal obligations by passing potential £££s tax & NI bills to agencies who lack negotiating power.


Back in October, APSCo met with HMRC who sought feedback on the use of contracted-out services / managed services / statements of work arrangements.


The new HMRC guidance has taken on board some of our feedback & is helpful - which is great to see & a success for APSCo.


However, I believe there has a missed opportunity to put a marker in the ground to say such practices are unfair. Whilst HMRC cannot interfere with contractual matters, if there had been some recognition in the guidance, this would have given agencies some leverage in their negotiations.
