Key to safely completing the Yorkshire 3 Peaks was preparing my Risk Mitigation Plan

I recently spent two days of intensive training in the Yorkshire Dales. The epic running adventure, across some of England's most stunning scenery, covered over 34 miles & 6,500 feet of elevation - up & down Pen-y-Ghent, Whernside & Ingleborough.


However the event was a stark reminder of the importance of managing risks, especially when tackling something like this solo. While I felt confident in my fitness, there's always the risk of unexpected weather, injuries, or getting lost.


The preparation before and during was critical. One of the risks in my Plan was the weather, which is why I was pleased to have packed my waterproof gear to keep myself dry & warm when the storm arrived ! 🌧️


This experience got me thinking about the risks recruitment agencies face. What do you think are the top 3 legal or compliance challenges facing the industry right now?


My top 3 are:

  1. Onerous contract indemnities for errors or omissions by clients - for example incorrect IR35 / Off Payroll Working determinations.

  2. Indemnities for vicarious liability - arising from the errors or omissions of the contractors placed be an agency - even though an agency had no ability to exercise any control or supervision over their contractors.

  3. Expectation that an agency accept liability for consequential losses - these losses are outside the control of an agency & cannot be quantified at the time of contract signature - so how can an agency be expected to accept.
